Primo enim considerare necesse est quis restituere cogatur. […] Ad horum tamen intelligentiam premittenda est prima hec regula generalis, que talis est: omne damnum quod quis dat, aut causa efficax est quod detur, satisfacere obligatur. Ex qua quidem regula elici potest quod tria sunt hominum genera que concurrere possunt in alienis iniuriis sive damnis: primo sunt quidam offensores; secundo sunt quidam consentientes; tertio sunt quidam participantes. Vel aliter dici potest quod primi sunt qui dant offensionem, secundi qui dant offensionis occasionem, tertii qui dant offensionis causam efficacem.

First, we must consider who is bound to make restitution. […] To understand this, we must first set forth the following general rule: everyone is bound to repair any harm he causes or for which he is the effective cause. From this rule we can infer that three kinds of persons may be involved in injuries or damages done to others: first, offenders; second, those who consent; third, those who participate. Or, put differently: the first are those who inflict the injury; the second, those who provide the occasion for it; the third, those who provide its effective cause.

First in a weekly series devoted to eight forms of religiosity concerning restitution, intended to prepare the faithful for true penance and the reception of the Eucharist. The eight forms address: who is bound to make restitution; what must be restored; how much; when; to whom; in what place; how; and why restitution must be made. Bernardino declares that he will not follow this order strictly throughout the week, since some topics require fuller treatment, while others call for a briefer discussion (f. o3rv).
(«Ut ergo disponere vos possitis omnes ad veram penitentiam et ad sacram communionem, in presenti septimana de alienorum restitutione agemus. De qua VIII religiositates principaliter considerare necesse est. Primo quis restituere obligatur; secundo quid; tertio quantum; quarto quando; quinto quibus; sexto quo loco; septimo quomodo; octavo quare restituendum sit. Nec tam curabimus in septimana presenti servare talem ordinem, quod quolibet sermone et die religiositas una tractetur, cum gravitas aliquarum earum maturiorem et longiorem postulet discussionem, aliqua vero breviorem et leviorem»). In this sermon, Bernardino announces three kinds of persons bound to restitution, but he discusses only the first and the second.
