Propterea visis iam tribus principalibus, scilicet quis obligatur ad restituendum et quid et quantum restitui deberet, iam quartum principale videndum est, videlicet quando homo restituere obligatur. Ad cuius declarationem triplex regula ponenda est.
• Prima autem regula pro primo articulo […] ponatur que talis est: non licet alienum invito domino aliquo tempore detinere, nisi circa hoc dominus in iudicio erret.
• (f. r8v) Secunda autem regula pro secundo articulo hec est: quandocumque res temporalis non potest restitui absque evidenti periculo damni debite rei incompatibiliter prevalentis, tunc homo restituere non tenetur.

Therefore, having now considered the three main points - namely, who is bound to make restitution, and what and how much must be restored - we must now examine the fourth, that is, when a person is bound to make restitution. To clarify this, we must set forth three rules.
• First rule […]: it is not lawful to retain another’s property against the owner’s will at any time, unless the owner is in error in judgment concerning it.
• (f. r8v) Second rule […]: whenever a temporal good cannot be restored without the evident risk of a loss that would prevail incompatibly over the due restitution, then a person is not bound to make restitution.
